Terms and Conditions of the Ginger.golf Silent Auction 2025 (“the Auction”)

1. General Information 

1.1 This silent Auction is organised by Josh Simpson (ginger.golf) (“The Organiser”) and the ginger.golf admin team in support of Tapping House Hospice (Registered Charity No. 1062800) and Macmillan Cancer Support (Registered Charity No. 261017). The Organiser is acting as a third-party fundraiser and is not an employee, agent, or representative of either charity.  

1.2 All net proceeds after payment processing or delivery costs will be donated equally to the named charities within 1 month.  

1.3 By submitting a bid, all participants (“Bidders”) agree to be bound by these terms & conditions. 

1.4 The Organiser reserves the right to amend or update these terms at any time. Any changes will be effective immediately so ensure that you check these terms and conditions before submitting a bid. 

1.5 Items are presented on an “as is” basis and no item will be the same. Participants are encouraged to read the particulars of each item in their entirety before placing a bid. 

1.6 Vouchers will have an expiry date which the round of golf or service will need to be used by. By submitting a bid you agree that winning items will be forfeited if not used within the listed timeframe. 

1.7 In no event shall the Organiser, Tapping House Hospice or Macmillan Cancer Support be held liable for any claim, demand or damages arising out of or in any way connected with the Auction or a participants purchase of an item. 

1.8 Whilst every effort has been made to accurately describe each item, the Organiser does not guarantee the accuracy of any item description. 

1.9 No refunds or exchanges will be offered unless required by law. 

1.10 If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. 

1.11 These terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. The parties submit to the exclusive jurisdiction of the English courts. 

2. Eligible Bidders 

2.1 All Bidders must be capable of entering into a valid and binding contract under the laws of England and Wales.  

2.2 Bids may not be made by any individual under 18 years of age or by any other persons who are legally prohibited from, or otherwise incapable of, entering legally binding contracts. Winning Bidders may be required to prove their age and verify thatr they are an eligible Bidder following the end of the Auction.  

2.3 Bids may not be made by any person with access to the ‘Quest For 581’ behind the scenes infrastructure, including but not limited to admin team members, and immediate family to ensure fairness and transparency. 

2.4 A binding contract for the sale and purchase of an item is formed once the Organiser notifies the successful Bidder by email confirming their winning bid and payment instructions. 

2.5 Winning Bidders agree not to resell or use any items for commercial gain without prior written consent of the Organiser. 

2.6 Winning Bidders may be contacted to ask for consent to their name and/or image being used in post-event promotional materials. 

 3. Bidding Process   

3.1 Bids must be submitted through the Auction platform on the gingergolf.co.uk website.  

3.2 Bids will only be accepted within the published Auction timeframe. Late Auction bids will not be considered. 

3.3 Participants may place bids on as many items as they wish. 

3.4 Participants may place more than one bid on the same item. Only the highest bid will be considered. 

3.5 All bids are binding. Once a bid is submitted, it cannot be withdrawn or amended. 

3.6 The Organiser reserves the right to disqualify any bids deemed to be fraudulent, incomplete or in breach of these terms.  

4. Winning Bids and Payment 

4.1 At the close of the Auction, the highest valid bid for each item will be deemed the winning bid. 

4.2 The Auction will begin at 10:00am GMT on 21 November 2025 (“Opening Time”) and end at 23:59pm GMT on 31 Jan 2026 (“Closing Time”). Any bids made before the Opening Time or after the Closing Time are invalid and will not be accepted. 

4.3 Winners will be notified by email from the following recipient with confirmation and details on how to pay: ginger.golf1@gmail.com 

4.4 Payment for winning bids must be made within 14 days of email confirmation. 

4.5 Some items may have a date by which they must be used or redeemed. Bidders should check that they will be able to use the item before its expiry date before placing a bid. No refunds will be offered to a Winning Bidder that is unable to make use of an item. 

4.6 The Organiser reserves the right to withdraw the prize and offer it to the next highest Bidder if payment is not made within the permitted timeframe. 

4.7 Payments must be made only via the method and details provided in the Winning Bidder’s confirmation email. The Organiser will never request payment via alternative accounts or links. 

5. Item Collection and Delivery  

5.1 Details regarding collection or delivery of items will be provided to successful bidders following payment confirmation. 

5.2 Where shipping is required, the participant may be responsible for applicable delivery or courier costs unless otherwise stated. 

5.3 The Organiser accepts no liability for items lost or damaged during delivery or transit. 

5.4 Some items will be subject to additional terms and conditions imposed by third parties. It is the responsibility of the Winning Bidder to ensure that they comply with all such terms and conditions associated with the item they have purchased.   

6. Privacy and Data Protection  

6.1. The Organiser will collect and process personal information in accordance with applicable data protection laws. 

6.2. By participating in the Auction, participants consent to the Organiser using their contact details for Auction administration and related communication purposes. 

6.3. Personal data will not be shared with third parties except where necessary to process bids, payments, or deliver Auction items. 

6.4 Bidder information will be securely deleted or anonymised within 90 days of the Auction’s conclusion, except as required by law for recordkeeping.

 7. Liability and Disclaimer 

7.1. To the maximum extent permitted by law, the Organiser shall not be liable for any loss, damage, or injury arising from participation in the Auction or the use of any item won. 

7.2  To the maximum extent permitted by law, the Organiser’s total liability arising from or in connection with this Auction shall be limited to the total amount paid by the relevant Bidder. 

7.3 The Organiser reserves the right to withdraw any item or cancel the Auction at any time without notice. 

7.4. Any disputes must be raised in writing within 14 days of the Auction’s close. The Organiser will review the matter in good faith and communicate a final decision, which shall be binding. 

7.5  The Organiser shall not be liable for any interruption, delay, or technical malfunction of the Auction platform that affects bidding. 

7.6 The Organiser shall not be liable for any delay or failure to perform due to events beyond their reasonable control, including but not limited to natural disasters, internet outages, strikes, or illness.
